How Bombardier processes your personal data

 

Privacy Statement & Consent Form

1. Purpose

 

Welcome to TALEO, a cloud-based talent management platform which collects relevant information to leverage talent insights to drive improved performance and business success. By accessing TALEO’s homepage and submitting your application, you agree to provide your personal data to Bombardier (as defined below) and that your personal data may be used, accessed, stored and processed according to the terms & conditions contained herein.

 

2. Our commitment

 

Bombardier Inc (the data controller), and all its groups, divisions, subsidiaries and affiliates ("Bombardier") (for more details see https://bombardier.com/en/who-we-are) is committed to conducting business in a way that complies with applicable data protection laws and regulations in every country in which Bombardier operates. These laws govern the collection, storage, processing and use of personal data. If you apply online for employment with Bombardier, please use the TALEO online portal to provide your personal data and any application documentation. The personal data you provide will only be used in order to effectively process your application and will not be linked to other databases unless you are hired.

 

3. Which personal data do we collect

 

As part of the recruitment process, you will be asked to provide personal data including, but not limited to, your name, residential address, date of birth, email address, phone number, qualifications, employment history, national identifier, etc.

 

Bombardier collects this information in a number of ways. It could be collected through an application form or through a CV or resume that you send us. Alternatively, we may receive your CV or resume from third party recruiters, from adverts recruiters place for us on social media or through our employee referral program. Bombardier has no control over the personal data you choose to provide on a CV or resume.

 

In certain countries, you will be asked to complete monitoring questions including, but not limited to, religion, ethnicity, race, gender, disability, criminal record, veteran status, etc. We only ask for this information when it is required to comply with our legal reporting requirements.

 

The information you provide will be saved on your TALEO account. This account is password protected. It will contain your profile which can be edited by you as required. As the owner of your personal data, it is your responsibility to keep it up to date. Therefore we recommend that you periodically review your personal data in TALEO.

 

4. Lawful basis for processing your personal data - Declaration of informed consent and cancellation

 

We process your personal data based on your consent. By clicking the “ACCEPT” button, you agree and consent that your personal data may be used, accessed, stored and processed according to the terms & conditions contained herein. If you do not give your consent, or if you cancel it afterwards, please be informed that your employment application will not be considered.

 

5. Access to your personal data

 

Only Bombardier employees or external contractors hired by Bombardier, who are bound by confidentiality obligations, will be able to access your application information as it is processed for the applicant selection.

 

6. How we store, transfer and protect your personal data

 

Your application may be handled by Bombardier employees or by external contractors hired by Bombardier across groups, divisions, subsidiaries and affiliates located in different geographical locations entrusted with the TALEO system.

 

Your personal data will be shared to facilitate the recruitment process as follows:-

  • internally, including with members of the recruitment team, managers in the business and the wider Human Resources community.

  • externally, including with recruitment contractors to support our internal staff through periods of high recruitment activity, third party recruiters, providers of online selection tests, other employers to obtain references, third party providers to obtain employment background checks or criminal record checks, IT support to maintain the system, etc.

Bombardier employees as well as external contractors hired by Bombardier are requested to comply with a strict Data Privacy Policy which ensures the protection of your personal data.

 

When we engage third parties to process personal data on our behalf, they do so on the basis of written instructions, are under a duty of confidentiality and are obliged to implement appropriate technical and organisational measures to ensure the security of your personal data.

 

Please note that your personal data will be transferred to countries outside the European Economic Area (EEA). Your application containing your personal data will be stored in the United States (http://www.oracle.com/us/legal/privacy/index.html) with our third party service provider, Oracle, whose registered office is located at the following address:

Oracle provides the hardware and software solutions for the application system and is responsible for maintaining it. Oracle has self-certified under the EU-US Privacy Shield Framework and thereby, guarantees an appropriate standard of data protection and operates to an appropriate standard of data security.

 

7. Your rights as a data subject / withdrawing your application
 

You will be provided a password-protected account to hold your application containing the personal data you provide. 

 

As long as the status of a job that you have applied for remains "Active", you can withdraw any of your applications by using the "Withdraw" function.

 

As a data subject, you also have a number of rights. You can:

  • access and obtain a copy of your personal data on request;
  • require Bombardier to change incorrect or incomplete personal data;
    • you can edit your personal data via your password protected account at any time.

  • object to the processing of your personal data;
  • ask Bombardier to stop processing your personal data for a period if your personal data is inaccurate or there is a dispute about whether or not your interests override Bombardier’s legitimate grounds for processing your personal data.
  • require Bombardier to delete or stop processing your personal data, for example where the data is no longer necessary for the purposes of processing or you withdraw your consent;

    • if you request the cancellation of your consent, your personal data will be removed from the TALEO system within a reasonable time and will be deleted subject to applicable statutory requirements regarding data retention. Please note that in the event of a legal dispute between you and Bombardier, your personal data may be retained until final settlement of the legal dispute.

If you decide to cancel your consent to the use, access, storage and processing of your personal data, please advise Bombardier by sending us an email at: taleosupport@aero.bombardier.com.  Following receipt of your request, a representative of Bombardier will follow-up with you in a timely manner. 

 

If you believe that Bombardier has not complied with your data protection rights, you can complain to your Supervisory Authority.

 

8. Retention of your personal data

 

Please note that Bombardier may not contact every applicant or interested party individually. The data of unsuccessful applicants will be deleted within a reasonable time, subject to applicable statutory requirements regarding data retention. The removal of your personal data from TALEO’s system does not require any further specific communication between Bombardier and you.

 

In your profile, which must be set up in your account, you can choose whether you are only interested in one particular job or would also like to be considered for future job vacancies (this option is not available in all jurisdictions). If you make such election, then your application information, including your personal data, will be kept for a longer period, to accommodate your request to apply for future job vacancies but eventually, your personal data will be deleted within a reasonable time, subject to applicable statutory requirements regarding data retention.

 
9. Automated Decision-Making
 

Employment decisions are not based solely on automated decision-making.
